ART. 129
The responsibilities of the local council
(1) The local council has initiative and decides, according to the law, on all issues of local interest, except those that are given by law to other local or central authorities.
(2) The local council exercises the following categories of powers:
a) powers regarding the administrative-territorial unit, its own organization, as well as the organization and functioning of the mayor's specialized apparatus, local public institutions, and local autonomous companies and agencies;
b) powers regarding the economic-social and environmental development of the commune, city, or municipality;
c) powers regarding the administration of the public and private domain of the commune, city, or municipality;
d) powers regarding the management of local interest services;
e) powers regarding inter-institutional cooperation at internal and external levels.
(3) In exercising the powers provided for in paragraph (2) letter a), the local council:
a) approves the statute of the commune, city, or municipality, as well as the regulations on the organization and functioning of the local council; an indicative model of the statute of the administrative-territorial unit, as well as an indicative model of the regulations on the organization and functioning of the local council, shall be approved by order of the responsible minister;
b) elects the deputy mayor/deputy mayors, from among the local councilors, at the proposal of the mayor or the local councilors, under the conditions provided in Art. 152 para. (2);
c) approves, according to the law, at the proposal of the mayor, the establishment, organization, and staffing of the mayor's specialized apparatus, local public institutions, the reorganization and staffing of local autonomous agencies, as well as the establishment, reorganization, or dissolution of local interest companies and their staffing;
d) exercises, on behalf of the administrative-territorial unit, all rights and obligations corresponding to the holdings held in companies or autonomous agencies, according to the law;
e) decides on the establishment or reorganization of institutions, public services, companies, and autonomous agencies, according to the law.
(4) In exercising the powers provided for in paragraph (2) letter b), the local council:
a) approves, at the proposal of the mayor, the budget of the administrative-territorial unit, credit transfers, the use of the budget reserve, and the closing account of the budgetary exercise;
b) approves, at the proposal of the mayor, the borrowing and/or guaranteeing of loans, as well as the contracting of local public debt through the issuance of securities, on behalf of the administrative-territorial unit, according to the law;
c) establishes and approves local taxes and fees, according to the law;
d) approves, at the proposal of the mayor, the technical and economic documentation for local investment works, according to the law;
e) approves strategies for economic, social, and environmental development of the administrative-territorial unit;
f) ensures a favorable environment for the establishment and/or development of businesses, including through the valorization of existing assets, as well as through the realization of new investments that contribute to the fulfillment of regional and local economic development programs;
g) ensures the execution of works and takes the necessary measures for the implementation and compliance with the provisions of the commitments undertaken by Romania as a member state of the European Union in the field of environmental protection and water management for the services provided to citizens.
(5) If the budget of the administrative-territorial unit, provided for in paragraph (4) letter a), cannot be adopted after two consecutive meetings, which take place within a maximum of 7 days, activity is carried out based on the budget of the previous year until the adoption of the new budget, but no later than 45 days from the date of publication of the state budget law in the Official Gazette of Romania, Part I.
(6) In exercising the powers provided for in paragraph (2) letter c), the local council:
a) decides on the administration, concession, lease, or free use of public property owned by the commune, city, or municipality, as the case may be, as well as local public services, according to the law;
b) decides on the sale, administration, concession, free use, or lease of private property owned by the commune, city, or municipality, as the case may be, according to the law;
c) approves or approves, according to the law, territorial planning and urbanism documentation for localities;
d) assigns or changes, according to the law, names of streets, squares, and any other objects of local public interest.
(7) In exercising the powers provided for in paragraph (2) letter d), the local council ensures, within its competence and according to the law, the necessary framework for the provision of public services of local interest regarding:
a) education;
b) social services for the protection of children, disabled persons, elderly persons, families, and other persons or groups in need;
c) health;
d) culture;
e) youth;
f) sports;
g) public order;
h) emergency situations;
i) environmental protection and restoration;
j) preservation, restoration, and enhancement of historical and architectural monuments, public parks, and nature reserves;
k) urban development;
l) population records;
m) bridges and public roads;
n) community public utility services of local interest;
o) emergency services such as mountain rescue, lifeguard, and first aid;
p) social-community administration activities;
q) social housing and other residential units owned by or managed by the administrative-territorial unit;
r) the valorization, in the interest of the local community, of the natural resources within the administrative-territorial unit;
s) other public services of local interest established by law.
(8) In exercising the powers provided for in paragraph (2) letter d), the local council:
a) supports, according to the law, the activity of religious denominations;
b) approves the construction of social housing, the criteria for the allocation of social housing and housing utilities owned or managed by it.
(9) In exercising the powers provided for in paragraph (2) letter e), the local council:
a) decides, according to the law, on cooperation or association with Romanian or foreign legal entities, for joint financing and implementation of actions, works, services, or projects of local public interest;
b) decides, according to the law, on the twinning of the commune, city, or municipality with administrative-territorial units from other countries;
c) decides, according to the law, on cooperation or association with other administrative-territorial units in the country or abroad, as well as on joining national and international associations of local public authorities, in order to promote common interests.
(10) In exercising the powers provided for in paragraph (2) letters a), b), and d), the local council:
a) may provide, in whole or in part, with the agreement of the owner of the property right or the right of administration, the works and funds necessary for the rehabilitation, equipping, and operation of buildings in which authorities or public institutions carry out activities of local interest. The goods purchased for equipment remain the property of the administrative-territorial unit;
b) may provide, in whole or in part, with the agreement of the institution or public authority holding the property right or the right of administration, works for the arrangement, equipment, and maintenance of buildings or land owned by the state, in order to increase the tourist attractiveness of the administrative-territorial unit, provided that, by expressed agreement, the holder of the right allows public access to the improved spaces for a period of at least 5 years. The goods purchased for equipment remain the property of the administrative-territorial unit.
(11) In order to fulfill the powers provided for in paragraph (2), the local council may request information and reports from the mayor, deputy mayor, and the heads of public service and public utility organizations of local interest.
(12) The local council decides on the granting of bonuses and other facilities, according to the law, to the personnel employed in the mayor's specialized apparatus and public services of local interest.
(13) The local council may confer the title of honorary citizen of the commune, city, or municipality, based on its own regulation, to Romanian or foreign individuals with outstanding merits. This regulation also determines the conditions for revoking the conferred title. This regulation may be an integral part of the statute of the administrative-territorial unit.
(14) The local council fulfills any other duties, in all areas of local interest, except those expressly given to other public authorities, as well as any other duties established by law.
